MOBOT Terms & Conditions of Sale - SG

These Terms & Conditions of Sale (“Terms”) apply to purchases made directly from MOBOT PTE. LTD. (UEN / GST Registration No. 200717700W) (“MOBOT”, “we”, “us” or “our”) in Singapore.

These Terms apply regardless of the MOBOT sales channel used, including MOBOT retail outlets, exhibitions, roadshows, our website at www.mobot.sg, telephone, WhatsApp and other direct MOBOT sales channels.

By placing an order or making payment to MOBOT, you acknowledge and agree to these Terms.

1. Orders and Acceptance

An order is confirmed when MOBOT accepts the order and receives any required payment or deposit.

Customers are responsible for checking the product, model, colour, specifications, quantity, price, delivery details and other particulars stated in the order before confirming the purchase.

Where there is an obvious error in pricing, product information, availability or order details, MOBOT reserves the right to correct the error or cancel the affected order. If MOBOT cancels an order for which payment has already been received, the amount paid for the cancelled item will be refunded.

All orders are subject to product availability.

2. Returns, Exchanges and Change of Mind

All sales are final.

MOBOT does not accept returns, refunds or exchanges due to change of mind.

This includes, but is not limited to, circumstances where:

  • the customer no longer wants or requires the product;
  • the intended user refuses or decides not to use the product;
  • the customer subsequently finds the same or a similar product at a lower price;
  • the customer selects the wrong product, model, colour, size or specification;
  • the product does not suit the customer's personal preference;
  • the customer's personal, financial, medical or other circumstances change after purchase;
  • the customer purchases another product instead; or
  • the product remains unused after purchase.

Customers should therefore carefully check all relevant product details and confirm suitability before completing their purchase.

This policy applies equally to purchases made through all direct MOBOT sales channels, including MOBOT retail outlets, exhibitions, roadshows, mobot.sg and direct remote orders.

Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded or limited under Singapore law.

3. Defective or Non-Conforming Goods

The no-change-of-mind policy in Section 2 does not affect any statutory rights that may apply where goods do not conform to the applicable contract of sale.

Where a customer reports that a product is defective or non-conforming, MOBOT may inspect, test and assess the product to determine the nature and cause of the reported issue.

Where applicable, remedies may include repair, replacement, reduction in price or rescission of the contract in accordance with Singapore law.

A refund or replacement is not automatically available merely because a product develops an issue. The appropriate remedy will depend on the circumstances and applicable law.

Nothing in MOBOT's commercial warranty limits any statutory right or remedy that cannot lawfully be excluded.

Singapore's Consumer Protection (Fair Trading) Act provides specific rights in relation to non-conforming consumer goods, including repair or replacement and, where the statutory conditions are met, reduction in price or rescission.

4. Prices and GST

Unless otherwise stated, prices displayed by MOBOT to consumers are in Singapore Dollars (SGD) and inclusive of prevailing Goods and Services Tax (“GST”).

Prices, promotions, gifts, discounts and offers may change from time to time.

A promotion, voucher, gift, discount or price available through one sales channel, location or event does not necessarily apply through another sales channel, location or event unless expressly stated.

Once an order has been confirmed, subsequent changes in MOBOT's selling price or promotional offers do not entitle the customer to a refund, credit or retrospective price adjustment.

5. Payment

Payment must be made using a payment method accepted by MOBOT.

Where an order has not been fully paid, the outstanding balance must be paid according to the agreed payment terms and, unless otherwise agreed in writing, no later than collection or delivery.

MOBOT may withhold delivery or collection until the amount due has been paid.

Ownership of the goods remains with MOBOT until full payment for the goods has been received, to the extent permitted by law.

Instalment, financing or buy-now-pay-later arrangements provided by banks, financial institutions, payment providers or other third parties may additionally be subject to the respective provider's terms and conditions.

6. Deposits

Where a deposit is required to confirm, reserve or procure an order, the deposit is non-refundable if the customer subsequently cancels the order or decides not to proceed, unless MOBOT expressly agrees otherwise in writing or a refund is required by law.

This includes deposits paid to:

  • reserve available stock;
  • secure a particular product, colour or configuration;
  • confirm promotional pricing;
  • place a pre-order; or
  • procure an item specifically for the customer.

Where MOBOT is ultimately unable to supply the ordered product and the parties do not agree on an acceptable alternative, amounts paid for the product that cannot be supplied will be refunded.

Any specific deposit or cancellation terms stated on the quotation, sales order, invoice or other transaction document will also apply.

7. Pre-Orders, Indent and Special-Order Products

Products that are pre-ordered, indented, customised, specially configured or specifically procured at a customer's request cannot be cancelled, returned, exchanged or refunded due to change of mind after the order has been confirmed.

Estimated arrival, completion and delivery dates are estimates unless MOBOT expressly agrees in writing to a guaranteed date.

Delays caused by manufacturing, shipping, customs clearance, regulatory processes, port congestion, freight disruption or other circumstances outside MOBOT's reasonable control do not by themselves give the customer a right to cancel the order.

Where MOBOT is ultimately unable to supply the ordered product, MOBOT may offer an alternative product or refund the amount paid for the product that cannot be supplied.

8. Product Selection and Suitability

Customers should consider the specifications, dimensions, weight, weight capacity, features and intended use of a product before purchase.

For mobility products, customers should also consider relevant factors such as:

  • the user's physical requirements;
  • user weight and size;
  • door and lift dimensions;
  • turning space;
  • slopes and gradients;
  • storage space;
  • vehicle or transport requirements;
  • the environment in which the product will be used; and
  • applicable laws, regulations and usage restrictions.

MOBOT may provide product information or recommendations based on information supplied by the customer.

Unless MOBOT expressly agrees otherwise in writing, the ultimate decision as to whether a product is suitable for the customer's particular requirements remains with the customer.

Nothing in this Section limits MOBOT's responsibility for any representation or obligation that cannot lawfully be excluded.

9. Product Information, Specifications and Appearance

MOBOT makes reasonable efforts to ensure that product descriptions, photographs, specifications and other information are accurate.

Actual product appearance may vary slightly from photographs due to factors including screen settings, lighting, production batches and manufacturer updates.

Manufacturers may make minor changes to components, packaging, finishes, colours or specifications from time to time.

Minor variations that do not materially affect the product's function, safety or intended use do not by themselves constitute a defect.

10. Delivery

Delivery dates and time windows are scheduled based on information available at the time of the order and may be subject to reasonable changes. MOBOT will contact the customer using the contact details provided and arrange an alternative delivery date or time window.

Customers must provide accurate and complete delivery information and ensure that the delivery location is accessible for the product being delivered.

Customers should inform MOBOT in advance of relevant access restrictions, including:

  • availability to receive the goods;
  • stairs;
  • narrow entrances or passageways;
  • lift size or weight restrictions;
  • restricted loading or unloading areas;
  • parking restrictions; or
  • other circumstances that may materially affect delivery.

Where delivery cannot reasonably be completed because:

  • incorrect or incomplete delivery information was provided;
  • access is not reasonably possible; or
  • relevant access restrictions were not disclosed,

Where delivery cannot be completed due to the circumstances stated above, a redelivery fee of $30 may apply.

MOBOT is not responsible for delays caused by circumstances outside its reasonable control.

11. Collection

Customers collecting products from MOBOT should check that the correct product and applicable accessories have been supplied.

Customers should collect their products within 7 days after being notified that the product is ready for collection.

Where a fully paid product remains uncollected for more than 7 days, MOBOT may give the customer at least 2 days notice before storage charges apply.

A storage fee of $10 per day may apply after the notice period.

12. Inspection Upon Receipt

Customers should inspect the product as soon as reasonably practicable after delivery or collection.

Visible transport damage, missing items or an incorrect product should preferably be reported to MOBOT within 24 hours of delivery or collection, together with photographs, videos or other relevant information.

Failure to report an issue immediately does not remove any statutory right that cannot lawfully be excluded.

13. Warranty

Products are covered by the applicable MOBOT commercial warranty stated at the time of purchase.

Warranty periods and coverage may vary depending on the product.

The MOBOT Warranty Policy forms part of these Terms.

Where a sales order, invoice or other transaction document expressly states the applicable warranty period or warranty type for a particular product, that product-specific information will apply.

MOBOT's commercial warranty is additional to, and does not exclude or limit, any statutory right or remedy that cannot lawfully be excluded.

14. Carry-In Warranty and Service

Where a product is sold with a carry-in warranty, warranty inspection, diagnosis and repair under MOBOT's commercial warranty are ordinarily carried out at the applicable MOBOT service location.

For claims made solely under MOBOT's commercial warranty, the customer is ordinarily responsible for bringing the product to and collecting it from the designated service location unless MOBOT expressly agrees otherwise.

A carry-in warranty does not ordinarily include complimentary collection, transportation, on-site servicing or return delivery unless expressly stated.

Where MOBOT agrees to provide additional transport, collection or on-site services outside the applicable warranty entitlement, charges may apply.

This Section does not require a customer to bear any cost that MOBOT is legally required to bear in providing a statutory remedy.

15. Warranty Exclusions, Wear and Tear and Misuse

MOBOT's commercial warranty does not cover matters excluded under the applicable Warranty Policy.

Depending on the product and circumstances, exclusions may include damage, deterioration or failure arising from:

  • normal wear and tear;
  • accident or collision;
  • misuse, abuse or improper operation;
  • overloading;
  • neglect or inadequate maintenance;
  • water damage or inappropriate environmental exposure;
  • use contrary to operating instructions;
  • unauthorised modification;
  • unauthorised repair or dismantling;
  • external impact or physical damage; or
  • consumable and wear-and-tear components.

Whether a reported issue arises from a manufacturing defect, normal wear and tear, misuse, external damage or another cause may require inspection and diagnosis.

Exclusion from MOBOT's commercial warranty does not by itself exclude any statutory right that may independently apply.

16. Display, Demonstration, Refurbished and Pre-Owned Products

Display, demonstration, refurbished and pre-owned products may exhibit reasonable signs of previous handling or use.

Where MOBOT specifically discloses a defect, cosmetic condition, damage, missing feature or other issue before purchase, the customer purchases the product subject to that disclosed condition.

The product's age, condition, usage, price and other relevant characteristics may be taken into account when assessing its expected condition and quality.

Any applicable commercial warranty for such a product will be stated at the time of purchase.

Nothing in this Section excludes or limits any right or remedy that cannot lawfully be excluded or limited under Singapore law.

17. Free Gifts and Promotional Items

Free gifts, complimentary accessories and promotional items have no cash value and cannot be exchanged for cash unless expressly stated.

Where a transaction is lawfully rescinded or refunded, MOBOT may require any promotional or complimentary items supplied as part of that transaction to be returned.

Where permitted by law, the reasonable value of an item that should be returned but cannot be returned may be taken into account when determining the final refund amount.

18. Vouchers, Credits and Promotional Codes

MOBOT vouchers, credits, promotional codes and discount codes are subject to any specific terms stated when they are issued.

Unless otherwise stated, vouchers and promotional credits:

  • cannot be exchanged for cash;
  • cannot be retrospectively applied to a completed transaction;
  • may be subject to an expiry date;
  • may be limited to selected products or services;
  • may be limited to particular sales channels; and
  • may not be used together with other promotions.

19. Trade-In Transactions

Where a transaction includes a trade-in, the stated trade-in value may be subject to inspection and verification of the traded-in product's model, condition, ownership and other relevant information.

Where information supplied by the customer concerning a trade-in product is materially inaccurate or incomplete, MOBOT may revise or withdraw the trade-in offer before completion.

The customer warrants that they are entitled to transfer ownership of the traded-in product to MOBOT.

Once a trade-in has been completed and the traded-in product has been surrendered to and accepted by MOBOT, the trade-in generally cannot be reversed merely because the customer changes their mind.

Any additional terms stated under the applicable MOBOT trade-in programme will also apply.

20. Product Registration and Regulatory Requirements

Certain mobility products may be subject to registration, technical, usage, age, certification or other regulatory requirements in Singapore.

Customers are responsible for complying with laws and regulations applicable to their ownership and use of the product.

Where MOBOT is required, or agrees, to perform registration or ownership-transfer procedures as part of the transaction, customers must provide accurate and complete information and reasonably cooperate with the process.

MOBOT does not guarantee that laws, regulations, approved product criteria or other regulatory requirements will remain unchanged after purchase.

A subsequent change in law or regulation does not by itself entitle a customer to return a product or cancel a completed purchase, except where required by law.

21. Safe and Proper Use

Customers and users are responsible for familiarising themselves with the product's operation, safety requirements, instructions and applicable rules before use.

Products must be used in accordance with their intended purpose, operating instructions, safety requirements and applicable law.

Where MOBOT provides a product demonstration or familiarisation session, this does not replace the user's responsibility to read and comply with the applicable operating and safety instructions.

22. Repairs and Servicing

Products submitted for servicing or repair may be subject to separate service terms, quotations or charges.

MOBOT may carry out reasonable inspection or diagnostic work before determining the cause of a reported issue and whether the work is covered under commercial warranty.

Repairs that are not covered by warranty are chargeable.

Unless otherwise agreed, chargeable repair work will proceed after the customer accepts the applicable quotation, estimate or repair charges.

Where appropriate, replacement parts used during servicing or repair may be new, refurbished or functionally equivalent, subject to applicable law and any specific terms communicated to the customer.

23. Third-Party Platforms, Retailers and Distributors

These Terms apply to purchases made directly from MOBOT.

Transactions made through third-party marketplaces, retailers, distributors or other sellers may additionally be governed by the terms, policies and procedures applicable to that seller or platform.

Where mandatory platform rules apply to a transaction, those rules may affect how payments, cancellations, disputes, refunds or other matters are processed.

24. Events Beyond MOBOT's Reasonable Control

To the extent permitted by law, MOBOT will not be responsible for a delay or failure to perform an obligation where the delay or failure results from circumstances outside MOBOT's reasonable control.

These circumstances may include:

  • natural disasters;
  • severe weather;
  • fire;
  • epidemic or pandemic;
  • war or civil disturbance;
  • industrial action;
  • transportation or freight disruption;
  • shipping delays;
  • port congestion;
  • import or export restrictions;
  • governmental action; or
  • regulatory changes.

Where circumstances outside MOBOT's reasonable control materially prevent MOBOT from fulfilling an order, MOBOT may, depending on the circumstances, arrange a revised delivery date, offer an alternative product, or provide another appropriate remedy, including a refund where applicable.

25. Liability

To the maximum extent permitted by law, MOBOT is not liable for indirect, incidental or consequential loss arising from the purchase, possession or use of a product where such loss is not recoverable under applicable law.

MOBOT is not responsible for loss or damage arising from:

  • misuse or improper operation of the product;
  • use contrary to the manufacturer's or MOBOT's instructions;
  • unauthorised modification or repair;
  • use of the product for a purpose for which it was not designed; or
  • failure to comply with applicable laws and regulations,

except to the extent that such liability cannot lawfully be excluded.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

26. Customer Information and Personal Data

Customers are responsible for ensuring that information supplied to MOBOT in connection with an order, delivery, registration, warranty claim, trade-in or service request is accurate and complete.

Personal data collected by MOBOT will be handled in accordance with MOBOT's Privacy Policy and applicable Singapore law.

27. Communications

MOBOT may contact customers using the telephone number, email address, messaging account or other contact details supplied in connection with an order or service request.

Customers should promptly notify MOBOT if relevant contact, billing or delivery information changes before the transaction has been completed.

28. Changes to These Terms

MOBOT may amend these Terms from time to time.

Unless otherwise required by law or expressly agreed, the Terms applicable to a transaction will be the version in effect when the customer's order was confirmed.

The current version will be published on www.mobot.sg together with its last-updated date.

29. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

30. No Waiver

If MOBOT does not exercise or enforce a right under these Terms on a particular occasion, this does not constitute a waiver of that right or prevent MOBOT from exercising or enforcing it subsequently.

31. Statutory Rights

Nothing in these Terms is intended to exclude, restrict or modify any right, remedy, guarantee, condition or liability that cannot lawfully be excluded, restricted or modified under Singapore law.

Where any provision of these Terms is inconsistent with a mandatory requirement of Singapore law, the mandatory legal requirement will prevail to the extent of that inconsistency.

32. Governing Law and Jurisdiction

These Terms and purchases made directly from MOBOT in Singapore are governed by the laws of the Republic of Singapore.

Any dispute arising from or relating to these Terms or a purchase from MOBOT is subject to the jurisdiction of the Singapore courts, without prejudice to any statutory dispute-resolution rights available to the parties.
